Only Automatic Driving School – Website & Social Media Privacy Notice

For Pass Photos, Videos & Testimonials – Dual Controller Model

Last Updated: October 2026 - This comes into force with the upcoming Code of Practice changes by the DVSA in early 2027
This notice explains how we use photos, videos and testimonials when you pass your test or have your first lesson, and how GDPR applies to both your instructor and Peter Scott.

1. Who Controls Your Image?

We operate with self-employed driving instructors who work under / alongside the Only Automatic Driving School brand. That means there are TWO separate Data Controllers, with a clear dividing line:

CONTROLLER 1 – YOUR INSTRUCTOR (Original Media – Instructor Controls His Own Responsibility):
Your instructor is the person who is with you on the day. He/she takes the photo/video on their own phone or camera. Your instructor is the independent Data Controller for that original file. They are fully responsible under UK GDPR for its security, storage, use for their own promotion, and for deleting it if you withdraw consent from them.

CONTROLLER 2 – PETER SCOTT T/A ONLY AUTOMATIC DRIVING SCHOOL (Forwarded Copy Only):
Peter Scott is NOT present when your photo/video is taken. Peter Scott only becomes a Data Controller for the specific copy that your instructor chooses to send to him. Peter Scott does NOT have access to your instructor’s phone or camera roll, does NOT automatically receive everything your instructor takes, and will NOT always receive any media at all. If your instructor does not forward it, Peter Scott holds nothing. If it is forwarded, Peter Scott is responsible only for that forwarded copy stored in the central Only Automatic systems.

Your instructor controls his own media responsibility. Peter Scott controls only what is forwarded to him.

2. What We Collect (Only With Your Explicit Written Consent)

We will only take and use your image if you sign our Dual Controller Image, Video & Testimonial Consent Form on the day. Consent is completely voluntary – it is NOT a condition of tuition.

This may include:
• Photo with our 'Pass Board' / first lesson photo
• Photo of you in or next to the tuition vehicle
• Short video clip / Reel (e.g. your reaction to passing)
• Dashcam / in-car footage (with option to blur your face)
• Written testimonial using first name only

We will NEVER use your surname, home address, licence number or personal social media tag alongside an image without separate verbal permission on the day.

3. Where Your Forwarded Image May Appear – Website & All Popular Social Media

If you consent to Part B (Peter Scott / Only Automatic central use), the specific file(s) forwarded by your instructor to Peter Scott may be used on:

Our Website: www.onlyautomatic.com – e.g. pass gallery / testimonials page

Facebook: Only Automatic Driving School Facebook Page and related posts / stories / Reels

Instagram: @onlyautomaticdrivingschool – feed, stories, Reels

Threads: @onlyautomaticdrivingschool

TikTok: Only Automatic Driving School – short clips / Reels

YouTube & YouTube Shorts: Only Automatic Driving School channel – pass reaction videos

Google Business Profile: Only Automatic Driving School – photo updates showing recent passes

Other central channels: WhatsApp Business status for Only Automatic, printed flyers, local press articles (where applicable)

Instructor’s OWN channels (under Part A – controlled by instructor): Their own Facebook profile/page, Instagram, TikTok, WhatsApp status, personal business website – this use is controlled by your instructor, not by Peter Scott

Important: We will not tag your personal Facebook/Instagram profile without asking you on the day. We never sell your image to third parties for their marketing.

4. Legal Basis & DVSA Code

Legal Basis: Consent – UK GDPR Article 6(1)(a). You give explicit written consent on our Dual Controller form.
DVSA Requirement: DVSA Code of Practice Section 13 requires us not to share client information, images or videos without explicit written consent. Our dual form is that explicit consent.
Both controllers rely on your consent for their respective copies. Peter Scott is NOT a data processor of your instructor – both are independent controllers for their own copies.

5. How Long We Keep It – Distinct Storage

INSTRUCTOR (Original): Stored securely on instructor’s own device / secure drive with access restricted to that instructor only. Kept up to 3 years from consent, unless you withdraw sooner from the instructor. Instructor is responsible for deleting the original.

PETER SCOTT / ONLY AUTOMATIC (Forwarded Copy Only): Stored securely in Only Automatic business Google Drive / business phone with access restricted to Peter Scott only. Only the files actually forwarded are stored. Kept up to 3 years from the date it was forwarded, unless you withdraw sooner from Peter Scott. If no file was forwarded, Peter Scott stores nothing.

Social media posts may remain visible after 3 years until manually deleted, as platforms retain posts. Printed materials already distributed cannot be recalled but will not be reprinted after withdrawal.

6. Your Rights – How to Withdraw

You can withdraw at any time, with no effect on your lessons. Withdrawal does not affect use that was lawful while consent was valid.

To withdraw from your INSTRUCTOR (original media – instructor controls his own responsibility): Contact your instructor directly using the contact details on your consent form. They must stop new use and delete their original within 30 days.

To withdraw from PETER SCOTT / ONLY AUTOMATIC (forwarded copy): Email pass@onlyautomatic.com with subject 'Withdraw Image Consent - Central' and call/text 07877 377 675 to confirm. Peter Scott will stop new central posts within 7 working days and delete his forwarded copy within 30 days.

To be fully removed, you need to contact BOTH controllers if you consented to both. If you withdraw from your instructor, your instructor will make reasonable efforts to tell Peter Scott, but you should also contact Peter Scott directly.

7. Complaints

You have the right to complain to the Information Commissioner’s Office (ICO) at ico.org.uk if you believe your data has been mishandled.
You also have rights of access, correction, deletion, restriction and objection. Contact the relevant controller to exercise them.

At Only Automatic Driving School, we love celebrating your pass! We will only use your photo, video or testimonial if you give us explicit written consent on the day using our Dual Controller consent form.

Your driving instructor takes the photo/video on their own phone and is independently responsible for it under UK GDPR – they control their own media responsibility, storage and deletion, and may use it for their own professional promotion (e.g. their own Facebook, Instagram, TikTok).

Peter Scott, trading as Only Automatic Driving School, is not present when the photo is taken. He only becomes responsible for the specific photo/video that your instructor chooses to send to him. He does not have access to your instructor’s phone and does not always receive media. If forwarded, he may use it to promote your pass on our central channels, including our website (www.onlyautomatic.com), Facebook, Instagram, Threads, TikTok, YouTube / YouTube Shorts and Google Business Profile. We never use your surname or tag your personal profile without asking you first.

Consent is voluntary and you can say no. You can withdraw at any time by contacting your instructor (for the original) and Peter Scott on pass@onlyautomatic.com / 07877 377 675 (for the central copy). Full details are in our full Image & Video Privacy Notice."
